New York State Senators introduce bill to decriminalize all drugs

Decriminalization of drugs in New York

New York senators, led by the Democratic Senator Gustavo Rivera and four co-sponsors introduced a bill aimed at decriminalize to a large extent drug possession in the state. The proposed legislation would eliminate the criminal and civil penalties for personal drug possession, while establishing a working group tasked with evaluating other reforms.

The explanatory memorandum for the bill emphasizes that the’Substance abuse is a health problem, but it has long been treated as a misdemeanor. He highlights the striking contrast between the treatment of people suffering from substance use disorders (SUDs) and that of people suffering from other illnesses, such as cancer or anxiety, as the current approach has led to the stigmatization, incarceration, and social marginalization people struggling with addiction.

A Public Health Approach to Drug Use

The bill aims to raise the New York's drug policy an approach to from criminalization to a harm-reduction approach. The memorandum accompanying the bill states the following:

«For too long, New York and the rest of the United States have focused their responses to drug use on law enforcement, continuing this approach long after it became clear that these costly policies were failing to achieve their intended goals—namely, the prevention of illicit drug use.»

The proposed law advocates, on the contrary, a an approach based on science and compassion, viewing people with TUS as patients in need of care rather than as criminals. The bill states that this change will help reduce overdose deaths, incarceration rates, and the spread of disease, while saving millions of dollars in public funds currently spent on incarceration.

The bill includes several significant reforms:

  • Decriminalization of personal possession : Instead of being charged with a misdemeanor, individuals found in possession of controlled substances would face only a $50 fine or would have the option of undergoing a health and social needs assessment.
  • No Incarceration for Unpaid Fines : The bill explicitly states that failure to pay fines will not result in additional penalties or imprisonment.
  • A working group on the decriminalization of drugs : The bill calls for the creation of a working group tasked with evaluating policies and recommending further reforms. The group will examine the following issues:
    • What amounts should be considered personal possession?
    • barriers to treatment and harm reduction services
    • policy changes aimed at promoting access to health care and social services.

Prominent figures from the public health, legal services, and government governance would be part of this group, which would ensure a multidisciplinary approach to drug policy reform.

This bill is almost identical to a proposal to decriminalize drugs introduced in 2023 by Senator Rivera, which was unsuccessful. His supporters, however, hope that shifting public opinion and the growing recognition of the’The Failure of Punitive Drug Policies will lead to legislative progress this time.

Broad efforts to reform New York's drug policy

The introduction of this bill comes as New York lawmakers are pushing for’other drug policy reforms. Among these are

  • Psilocybin Therapy for Medical Conditions : Another bill, introduced by the Senator Nathalia Fernandez, aims to legalize the psilocybin-assisted therapy for patients with qualifying conditions.

Meanwhile, the ‘New York's legal cannabis industry continues to grow. Recently, Governor Kathy Hochul  announced that the legal cannabis market of the State had surpassed $1 billion in sales since its launch in 2022. Despite initial challenges, including legal actions and regulatory hurdles, sales have picked up thanks to an increase in the number of licenses and the’enforcement of the law against unlicensed clinics.

Governor Hochul highlighted the economic and social benefits a well-regulated cannabis market, stating that the state’s industry is designed to prioritize equity, public safety, and community empowerment.
