MILDECA takes stock of CBD legislation
Following the Kanavape verdict before the Court of Justice of the European Union, which, in a nutshell.., makes France's alleged ban on cannabidiol illegal, the MILDECA, standard-bearer of the «Say no to CBD» campaign, has modified his update on CBD legislation.
As a reminder, the initial text mentioned :
«Thus, certain varieties of cannabis or hemp, devoid of narcotic properties, may be used for industrial and commercial purposes under three cumulative conditions:
- authorized hemp varieties are listed ;
- only seeds and fibers may be used. The use of flowers is prohibited; ;
- the plant must have a THC content of less than 0.2%».»
The second point above was largely invalidated by the CJEU, who noted that CBD is legal even though it «is extracted from the Cannabis sativa [hemp] plant in its entirety and not just from its fibers and seeds».
MILDECA has also removed the reference to the ban on CBD flowers and the presence of THC in the finished product. of its new «A »legislative update".
The French organization, however, remains unchanged in its approach to the subject, stating that «the authorities are already reiterating their warnings about the potentially harmful effects of the as yet little-known CBD molecule. They also point out the health risks associated with Δ-9-tetrahydrocannabinol (THC), a molecule classified as a narcotic, which hemp products are likely to contain».
In 2018, the WHO recommended not classifying CBD as a controlled substance, all such as hemp extracts with -0.2% THC in 2019. Maybe MILDECA still hasn't got the Telex...
For the record, here is the MILDECA's previous position, as we wrote in June 2018, was «scientifically backed and complied with European legislation» (no).
