Which countries in Europe have legalized cannabis?The cultivation of cannabis for medical purposes is authorized after obtaining a license to plant cannabis plants and an authorization to dispose of addictive substances and products related to medical cannabis.
The license is issued by the National Institute of Drug Control for a maximum period of five years, and may be extended (the request for extension must be submitted by the licensee no later than six months before expiry).
Medical cannabis grown in the Czech Republic can only be sold to another holder of the authorization issued by the Ministry of Health; the same applies to the transfer of other rights related to addictive substances.
Importing cannabis for medical use requires an import permit issued by the Ministry of Health. This permit is issued for a maximum period of three months. An individual permit is required for each import.
Patients can only access cannabis for medical use with an electronic prescription from a healthcare professional, only for patients aged 18 or over, and only for certain symptoms, such as chronic inconsolable pain or nausea in connection with the treatment of HIV disease.
The quantity is limited to a total of 180 g of dry cannabis per person per month. As regards the use of cannabis in outpatient care, public health insurance covers only 90 % of the price of cannabis for the end consumer, up to a limit of 30 g of medical cannabis per person per month, or up to 180 g per month if the patient's state of health so requires.
Cannabis containing a maximum of 1 % THC is authorized for industrial, technical and gardening purposes, including for sale.
The legal rules governing the use of cannabidiol (CBD) in different products are not unified in the Czech Republic, and this area is evolving rapidly.
Various CBD-based products are sold in the Czech Republic.
Under current legislation, the use of CBD in e-cigarettes is not permitted at all. However, the use of CBD in herbal cigarettes is permitted.
As far as CBD cosmetics are concerned, Czech law requires only that they be THC-free. Consequently, THC-free CBD cosmetics are legally permitted.
