Czech Republic proposes legalizing cannabis cultivation for personal use
The ministry of justice The Czech delegation proposed an amendment aimed at legalize the cultivation of up to three cannabis plants for personal use by individuals over the age of 21.
Redefining the legal boundaries of cannabis cultivation
Under the proposed changes, growing up to three cannabis plants for personal use will no longer be considered a criminal offense. However, planting more than five plants will still constitute a criminal offense.
In addition to these limits, the legal possession of cannabis will also be subject to specific restrictions. Individuals will be allowed to possess up to 50 grams of dried cannabis at home and 25 grams outside their home.
Currently, possession of more than 5 cannabis plants or 10 grams of dry matter for personal use is considered a criminal offense. The department now wishes to redefine these limits by setting the threshold between a criminal offense and a criminal offense 5 plants or 100 grams of dry materials inside the home, and to 50 grams outside the home.
The Department of Justice explained the rationale behind this amendment by pointing out the inconsistency in how cannabis is treated compared to other substances narcotic or psychotropic substances.
The ministry emphasized that international treaties and EU regulations support the idea of lighter sanctions for the cultivation and processing of cannabis for personal use than for other substances.
Tackling Drug Abuse
Another key aspect of the amendment is the potential change to the law regarding the the spread of drug abuse. This offense, which involves encouraging another person to abuse an addictive substance, is currently punishable regardless of the age of the person involved.
However, under the new proposal, the ministry is considering two options: maintaining the status quo or limiting this offense to cases involving children.
If the draft legislation has enjoyed some public support, but it has also faced difficulties. Several government agencies, including the Ministry of Regional Development and the ministry of agriculture, have expressed concerns, particularly regarding the broader implications of drug deregulation.
