Legalization of cannabis in Spain

In Spain, the debate over the legalization of cannabis is in the hands of the Senate. In fact, a non-legislative proposal was presented on March 17 by the parliamentary group Unidos Podemos and the platform Responsible Regulation composed of citizens and advocacy groups, to discuss the full legalization of cannabis for both medical and recreational purposes. Unlike the the latest bill that was introduced in late January, a resolution is a formal proposal drafted by a body (such as a parliamentary group) that is not legally binding and therefore carries no legal obligation. It is simply used to express approval.

While explaining that the status of cannabis in Spain is subject to «legal uncertainty,», Unidos Podemos and Responsible Regulation insist on providing the country with «sufficient flexibility to formulate and implement national drug policies in accordance with their priorities and needs.» They also point out that in Spain, cannabis possession has never been a criminal offense and that regulation will help prevent black-market trafficking. Furthermore, it should be noted that some major cities, such as Barcelona, tolerate the activities of Cannabis Social Clubs.

In this bill, proponents of regulation point to the global situation regarding cannabis in order to clear up the ambiguity that persists around current regulations, notably by citing U.S. states that have legalized recreational cannabis  such as Alaska, Oregon, Washington, and Colorado, stating that they «regulate the entire recreational cannabis cycle, from production to consumption, through distribution at pharmacies, retail outlets, consumer cooperatives, or through personal cultivation»

Meanwhile, the Assembly of Extremadura, a region in the southwestern part of the country, unanimously approved last week a proposal by citizens to ask the Spanish government to regulate cannabis medical. The Extremadura Parliament wants to address cannabis cultivation, an interesting measure that could boost the region and create jobs in rural areas.

The resolution also explains that the end of the ban on cannabis in Spain should be considered and that it can be reconciled with the law while ensuring adequate protection for the product and consumers. It remains to be seen whether the Senate will take up the matter!
