France proposes to classify CBD as «toxic» at European level
According to information tracked by CosmeticOBS, France's intention to classify CBD as toxic at European level is now an official proposal.
If the process is completed, CBD will be banned from cosmetic products in Europe, with implications for other types of product that are difficult to gauge.
What happened?
In June 2023, France announced its intention to ban the use of cannabidiol (CBD) in cosmetic products in Europe.
The idea was to classify CBD as CMR, i.e. Carcinogenic, Mutagenic and toxic for Reproduction, and therefore prohibited in cosmetic products in Europe.
As we explained at the time, the CBD is in the CosIng, is the European database of all cosmetic ingredients approved in Europe, for anti-sebum, antioxidant, moisturizing and skin-protecting uses, but is not regulated by Cosmetic Regulation 1223/2009 on cosmetic substances and ingredients.
In 2023, the European Commission launched a call for data with the aim of preparing a mandate for the work of a Scientific Committee (CSSC). The latter should soon have to rule on the safety of CBD, taking into account the possible unintentional presence, in trace amounts, of other substances. cannabinoids, including THC.
France's position is to ban it for its alleged «reprotoxic» nature, a proposal published on September 11 by the European Chemicals Agency (ECHA). If CBD is listed as toxic for reproduction, it will be banned in cosmetic products in Europe, unless exempted from the ban following an opinion from the SCCS, says CosmeticOBS.
And from our understanding, would open the door to further prohibitions.

Once again, France is playing a harmful role, and once again, Europe will be accused of being an instrument at the service of industry lobbies.
We need to get away from this regulatory madness that allows the use of glyphosate, but now claims to ban cannabidiol.
