Blocking Cannabis Clubs in Bavaria

The legalization of cannabis in Germany April 1, 2024, was supposed to mark a turning point in national drug policy. With the German Cannabis Act (CanG), individuals have been granted the right to possess and use cannabis, while cannabis social clubs (CSC) have been authorized to grow plants collectively for up to 500 members. Nearly 300 associations have already been formed across the country.

But in Bavaria, progress has stalled. Although the Regional Office for Health and Food Security (LGL) has issued eight cultivation licenses, no club was able to start farming. Local authorities, on the instructions of the Bavarian Ministry of Construction, have imposed zoning requirements that effectively prevent CSCs from using their permits.

Bureaucratic obstacles

This situation shows just how much federal legalization may be limited at the state level. According to Business of Cannabis, the association CannabisKultur MainSpessart e.V. waited a year to obtain a license from the LGL, only to be told that its cultivation site required a new land-use plan. President Emilio Fischer denounced these measures as «a deliberate attempt to hinder operations.» He estimates that adapting the local zoning plans could take two to three years and cost tens of thousands of euros.

The newspaper Bavarian State Gazette revealed that an internal directive from the highest construction authority, issued in December 2024, required municipalities to permit CSCs only in special-use zones, excluding industrial and commercial zones. This interpretation adds an additional layer of cost and complexity for associations.

Similar obstacles have been reported elsewhere. Mr. Pley, who obtained internal documents through a data protection request, believes that the state’s actions go beyond legal interpretation and constitute an attempt to criminalize CSCs.

L’German Cannabis Association shares this view, according to its spokesperson Elmar Daniel noting that Bavaria is the only federal state to require special zoning for CSCs. He warned that these requirements lead to prohibitive costs and significant delays: «The zoning process alone would cost five-figure sums,» he told Christ, in an article published in Cannabis Cultivation in Bavaria.

The government is defending its restrictive stance

The Bavarian Ministry of Health openly defended its position. A spokesperson reiterated that the legalization of cannabis was a mistake, particularly with regard to the protection of youth and public health. «From the very beginning and with full knowledge of the facts, Bavaria has sought to apply the provisions of the KCanG as restrictively as possible,» the ministry stated in a press release.

The official figures illustrate the impact: of the 44 applications submitted in Bavaria, 14 have already been withdrawn, three have been rejected, and 19 are still under review.
