MILDECA takes stock of CBD legislation

All it took was waiting 30 minutes after our article « MILDECA considers controlling CBD cannabis stores »so that MILDECA can post its state-of-the-art report on cannabidiol online.".

Noting the growing popularity of CBD products—including e-liquids for e-cigarettes as well as CBD flowers—MILDECA reminds consumers of «the regulations applicable to these products.».

In a nutshell:

• The hemp varieties authorized for industrial and commercial use are those listed in the French and European catalogs
• The use and sale of hemp flowers or leaves, or of products derived from these parts of the plant, are not permitted, regardless of the variety
• E-liquids and other products CBD products are prohibited if they contain THC, regardless of the amount, and if they are not derived from authorized varieties and plant parts (meaning no CBD derived from hemp flowers and no full-spectrum CBD e-liquid or oil)
• No therapeutic benefits may be claimed—in particular by manufacturers and sellers of products containing CBD—and the same applies to advertising.

The full article can be read at the MILDECA website and generally follows the RESPADD's recommendations made last March.

This raises questions about the future of stores that sell CBD flowers, CBD products derived primarily from flowers (and how to regulate them, not to mention the impossibility of knowing whether they come from a plant listed in the catalog or not), and the possibility of having zero traces of THC in cannabis-derived products.
