Agnès Buzyn: «the legislation on 0.2% may be a little vague».»
The next installment of the summer series «Agnès Buzyn, MILDECA, and Cannabis.».
Agnès Buzyn, a guest on RTL's *Grand Jury* this Sunday, June 17, spoke out on the rise of CBD flower shops: «We’re going to have to review the legislation and figure out how to bring order to all of this,» referring to a joint effort with the DGCCRF. «Today, any sale of cannabis for recreational use that contains THC, regardless of the dose, is normally a criminal offense.”. But it's true that the laws regarding 0.2% can be a little vague« .
Surprisingly, the Minister of Health is therefore not acknowledging the «Reminder of the law» on CBD issued by MILDECA last week, even though the law seems very clear to them. So what is the purpose of MILDECA? That is the question.
Capital also reported that last week that it took MILDECA 9 (nine, NINE) months—and the input of numerous experts—to clarify the current legislation on hemp flowers and CBD, while failing to take into account European law, which takes precedence over French law. On this last point, Three experts gave us their opinions and the legal avenues that support this approach. If it takes nine months and a whole team of specialists to clarify a law—without realizing that it’s already covered by European law—perhaps that’s because the current legislation and the experts consulted are flawed. #justsaying.
The JDD also revealed that a preliminary investigation was opened on June 11 by the Paris Public Prosecutor’s Office against the Cofyshop on Rue Amelot (11th arrondissement, Paris) and referred to the Narcotics Brigade. The investigation will be tasked with verifying the legality of the products being sold, though it is not yet clear which law it will be based on.
Regarding medical cannabis, Agnès Buzyn confirmed on RTL that options for French patients are currently being explored.
«We can extract pain-relieving molecules from cannabis to make medications (…) we already have the therapeutic arsenal,» she noted. «That said, some people would like to see it used in cigarettes. The risk, of course, is that it could be misused.».
Pharmaceutical forms of cannabis therefore appear to have already been «approved» for patients who do not respond to traditional treatments, while the possibility of purchasing dried flowers at pharmacies remains up in the air.
To be continued.
