Delaware unveils cannabis regulation as state prepares for legalization
The Delaware, like 21 American states before it, is preparing to launch its adult-use cannabis market. The state authorities recently published their draft regulations defining the framework for this new industry, which is due to launch next year.
Draft regulations unveiled
L’Office of the Marijuana Commissioner (WTO) of Delaware has unveiled a draft regulations for the future cannabis for adult use of the state. These regulations, published last week, give an idea of the preliminary framework for the different types of’cannabis companies.
According to the WTO, this regulation project is likely to be modified in line with the legislative changes proposed by the General Assembly. Delaware authorities are currently seeking public comment on the proposed rules, with an informal public comment period open until March 29. This will be followed by a formal public comment period from May 1 to May 31, after the publication of additional regulations.
While the initial plans called for cannabis sales to reach begin in March 2025, the authorities are planning to authorize medical cannabis dispensaries to serve existing adult consumers more early. The adult-use cannabis program plans to finalize the rules by July 11, accept license applications in September, and approve the various license types on a staggered schedule from October onwards.
In addition to preparations for the adult-use cannabis, the Delaware House of Representatives recently approved a bill to extend the state medical cannabis program. Proposed changes include removing limitations on patient eligibility based on specific health conditions, and allowing patients over 65 to self-certify for access to the medical marijuana without a doctor's recommendation.
Delaware has also shown its support for the federal cannabis reform, with the State Senate passing a resolution urging Congressional representatives to support legislation to end prohibition federal cannabis.
