Which US states will vote on cannabis legalization in November 2024?

The first American state to legalize cannabis, Colorado, did so 12 years ago. This November, five states will ask voters whether or not they wish to change their laws on the subject.

Florida and Amendment 3

La measure proposed by Florida is a constitutional amendment that would legalize the recreational use of cannabis for adults aged 21 and over.

Medical cannabis companies currently authorized to cultivate medical cannabis, and which largely finance the pro-legalization campaign, will be able to start transferring their activities to the recreational market and selling to adults over 21.

Florida is already the largest medical cannabis market in the US, with over 871,000 registered patients. The new law would not allow home cultivation.

North Dakota

Measuring North Dakota will once again ask voters if they want to legalize the production, sale and consumption of cannabis for recreational purposes for people aged 21 and over. Currently, only medical cannabis is legal in North Dakota.

South Dakota

The distribution, possession and consumption of cannabis for recreational purposes would be legal for adults aged 21 and over under the measure proposed by South Dakota and put to the vote on November 5.

Adults would be allowed to possess up to two ounces (56 grams) of cannabis and could own up to six Cannabis plants, with a maximum of 12 plants per household.

Medical cannabis is already legal in South Dakota.

Nebraska

Two bills on medical cannabis are put to the vote on November 5 in Nebraska.

Initiative 437 would allow individuals, upon written recommendation from a healthcare provider, to possess up to five ounces (140 grams) of cannabis for medical purposes without incurring legal penalties.

Initiative 438, entitled Medical Marijuana Regulation Initiative, provides for the repeal of penalties for the possession, distribution, delivery and dispensing of cannabis for medical use.

The measure also provides for the creation of the Nebraska Medical Cannabis Commission (Nebraska Medical Cannabis Commission), responsible for regulating the use of medical cannabis in the state.

Both medical and recreational cannabis are illegal in Nebraska.

In the run-up to the election, Donald Trump and Kamala Harris both expressed their views on cannabis legalization.
