Virginia remains one of the strangest cannabis experiments in the U.S.-a place where adults can legally grow, possess and share cannabis, but can't legally buy it.

Four years after becoming first Southern state to legalize cannabis for adult use, the Commonwealth remained stuck halfway through the process.

In 2021, a landmark bill allowing adults over 21 to possess up to an ounce of cannabis and grow up to four plants per household was passed. This legislation was intended to be the first step towards a regulated retail market. But this second step - the creation of licensed dispensaries - never saw the light of day.

Governor Glenn Youngkin, a Republican, has repeatedly vetoed bills that would have established a framework for retail sales, arguing that legalization had already gone too far. The result is a strange half-way legalization, where personal use is tolerated, but the supply chain remains clandestine.

This vacuum has created what many call a «grey market»: unregulated stores and delivery services openly selling THC products under the guise of hemp. Enforcement is inconsistent: some businesses are raided by police, while others operate for months unchecked. Critics argue that this selective tolerance benefits no one - not consumers exposed to untested products, not legitimate entrepreneurs, and certainly not the state, which is depriving itself of hundreds of millions in potential tax revenue.

Meanwhile, medical cannabis is quietly evolving. The state's Cannabis Control Authority (CCA) took over regulation in 2024, streamlining patient access by eliminating registration cards and allowing certified practitioners to issue direct recommendations. The medical market is small but stable - a rare patch of clarity in Virginia's otherwise confusing cannabis landscape.
