Medical cannabis: legal and regulated

  • Medical cannabis has been legal in Pennsylvania since 2016 under the Medical Cannabis Act (Act 16).
  • Patients with eligible serious illnesses can register, obtain a doctor’s certification, and purchase cannabis at licensed dispensaries.
  • Approved forms include tablets, tinctures, topical products, oils, liquids, and sprays; the smoking products are generally not allowed in the
  • There are restrictions on dispensing: patients may only receive a supply for approximately 90 days at a time, as determined by pharmacists or the regulatory framework.

Recreational use: still illegal, but changing

  • Recreational cannabis (that is, non-medical use by adults) remains illegal throughout the state.
  • Possession of small amounts without a medical prescription may result in penalties: fines, misdemeanor charges, or even prison sentences, depending on the amount.

Decriminalization and Local Exceptions

  • Some cities/municipalities have adopted the decriminalization small quantities, which means that the penalties are less severe (civil fines) rather than criminal prosecution. Examples include Philadelphia, Pittsburgh, York, Erie…

Remaining Constraints and Obstacles

  • Home cultivation remains illegal. Patients or individuals generally cannot grow their own plants unless they have a license issued in accordance with state regulations.
  • Bills on recreational use are gaining support and momentum, but the Senate Republicans often oppose them or have proposed amendments. The bills passed by the House of Representatives have not yet taken effect.
  • Federal law still classifies cannabis as a Category I substance, which creates legal and regulatory conflicts, particularly for public institutions and federal properties.
