Presented by the Australian Greens senator David Shoebridge in August 2023, the bill sought to establish a national framework for the legalization and regulation of Cannabis in Australia. Despite this setback, the discussion highlighted critical perspectives on the potential benefits and challenges of legalization.

Key Provisions of the 2023 Cannabis Legalization Bill

The The bill proposed from:

  • Set the’legal age for access to 18 years old
  • Allow households to grow up to six cannabis plants
  • Establish «cannabis cafes» as spaces for retail sales and outdoor consumption
  • the creation of a regulatory body, the Australian National Cannabis Agency, responsible for overseeing production, issuing retail licenses, and establishing a cannabis variety registry

The bill also included provisions to exempt the Indigenous Australians license fees.

In his closing remarks, Senator Shoebridge emphasized public support for legalization, noting that it could reduce the harms associated with the illicit cannabis market.

«We see so many positive aspects to the legalization of cannabis,» he said, advocating for a model that avoids the involvement of “big pharmaceutical, tobacco, and alcohol companies” while prioritizing evidence-based regulation.

Mr. Shoebridge highlighted international examples, such as Canada and certain parts of Europe, as models for developing a balanced legalization framework. Proponents of cannabis legalization have argued that it could reduce harm, create safer consumption spaces, and undermine the illicit market.

Conflicting viewpoints and discrepancies in the data

Opponents such as Senator Paul Scarr have expressed concerns about the effectiveness of legalization in the fight against organized crime. Citing a Deloitte study Regarding the Canadian cannabis market, Mr. Scarr stated that up to 52% of cannabis sales in Canada still take place on the illicit market, a figure he linked to ongoing criminal activity.

The most recent data from Statistics Canada However, they paint a different picture. According to the’2023 Canadian Cannabis Survey, 73% of cannabis users reported purchasing cannabis from legal sources, and only 3% to 5% from illicit sources. These results suggest a trend toward increasing trust in regulated markets over time, which calls into question Mr. Scarr’s claims.
