Nearly 130 Cannabis Clubs now approved in Germany

The Cannabis Social Clubs (CSC) are gradually opening up in Germany following the partial legalization of cannabis. Since July 1, 2024, these cultural associations are authorized to operate under strict regulations, offering a legal alternative to the black market.

Approval and implementation of these clubs vary considerably from one Land to another, Some federal states are leading the way, while others, such as Bavaria, are notably lagging behind.

The disparity of cannabis club approvals in Germany

To date, Germany has almost 130 Cannabis Social Clubs, but their distribution is far from uniform. Visit Lower Saxony is a pioneer, having approved the first club from July 8, 2024. In November, the Social Club Ganderkesee is became the first in Germany to legally distribute cannabis to its members.

According to Georg Wurth, President of’German Hemp Association, the Land Ministry of Agriculture, directed by Miriam Staudte, a member of the Green Party, took a pragmatic approach to the approval process: « She realized that culture clubs could help fight the black market. That's why they've decided to treat requests rather favorably».» he explains to Augsburger Allgemeine.

The North Rhine-Westphalia (NRW), which shares its border with the Netherlands, tops the ranking with 37 approved clubs, followed by the Lower Saxony with 25. In these Länder, the procedure was relatively efficient, with some applications processed within a few days, provided they had been well prepared.

Bavaria's resistance to cannabis social clubs

On the contrary, Bavaria has not approved a single Cannabis Social Club. L’Bavarian Office for Health and Food Safety (LGL) received 29 requests, but none were approved.

According to Wurth, «Bavaria announced from the outset that it would interpret the law in the most repressive way possible». Indeed, the Minister-President Markus Söder is still opposed to cannabis reform and ensured that Bavaria applied additional restrictions to the federal law.

The Bavarian law further complicates matters by prohibiting consumption in areas where smoking is permitted, such as restaurant terraces. Many applicants remain in a state of uncertainty, despite the considerable financial investments they have made to obtain property and prepare their application.

« Some have invested a lot of money, others are already paying rent... each month's delay is a threat to our existence. »explains Mr. Wurth.

The authorization procedure for Cannabis Social Clubs is expected to last a maximum of three months once all required documents have been submitted. However, vague and changing requirements lead to complications. One such problem is the mandatory training (and at a cost of around €600) for prevention officers, which was a stumbling block for many candidates.

Whereas Lower Saxony has allowed clubs to present this certification at a later stage, Bavaria insists that it be included from the outset.

The future of social cannabis clubs in Germany

As the federal election approaches, the fate of the Cannabis Social Clubs remains uncertain. Critics believe that deliberate delays in Bavaria could be a political maneuver aimed at delaying progress until a possible change in national policy. In the meantime, frustration is mounting among claimants, and legal action may soon follow. German Hemp Association, and several members of parliament have already taken legal action against Bavaria's restrictive policies.

Despite these difficulties, the steady expansion of Cannabis Social Clubs in other states is a sign of growing acceptance of legal cannabis cultivation. Visit success of these clubs in states such as Lower Saxony and North Rhine-Westphalia could ultimately serve as a model for the rest of Germany. It remains to be seen whether Bavaria will eventually follow suit, or whether it will remain an exception in the national cannabis reform landscape.
