Luxembourg publishes details of its «recreational cannabis» project»

While Luxembourg's coalition agreement had legalized cannabis in its entirety in 2019, the government recently reduced the scope of cannabis legalization in Luxembourg to allow only self-cultivation of cannabis, 4 plants per household.

While a few details had already been released by the Luxembourg authorities, yesterday the government put the following online a more complete version on the future authorization of personal cannabis cultivation:

• the authorization of 4 plants is per household and not per adult per household
• the plants must come from seeds, available online in Luxembourg or abroad, or in stores. There is no seed purchase limit.
• domestic production of seeds for commercial purposes will be allowed: «It would be inconsistent for consumers to be able to legally acquire seeds from abroad, while domestic production would remain prohibited» (which doesn't seem to bother the French government for CBD, but that's another story).
• the plants can be grown indoors or outdoors, on land adjacent to the home, without being visible from the public highway
• the ban on drinking in public will be maintained
• the donation or sale of cannabis or cannabis products will be prohibited
• a fine for possession of up to 3 grams of cannabis in public will be introduced, with a warning charge of €145. Above 3 grams, the offender will continue to be treated as a drug dealer.
• the THC threshold in the blood when driving will remain unchanged (1ng/mL) and will always be equivalent to zero tolerance

However, this highly restrictive «decriminalization» still worries Luxembourg's neighbors, who had already lobbied to prevent legalization. Le Monde tells us that Meurthe-et-Moselle in France, or the nearest German town, Trier, feared that cannabis would be added to the list of products imported by cross-border commuters, after alcohol, tobacco and fuel. With a simple authorization to cultivate without possession in public, their fears should be alleviated.
