Cannabis self-cultivation in Costa Rica: draft law opens debate

The Broad Front, a left-wing Costa Rican political party, has announced a new bill aimed at legalizing the personal cultivation of cannabis. The proposal, championed by Representative Ariel Robles, aims to steer consumers away from the illicit market and establish a regulated, science-based framework for the personal and domestic cultivation of cannabis.

The Prevalence of Cannabis in Costa Rica

This measure comes at a time when Costa Rica has seen a significant increase in cannabis use. According to data from the 7th National Survey on Psychoactive Substance Use among Households Aged 12 to 70 in 2022, conducted by the Institute on Alcoholism and Drug Addiction (IAFA), cannabis use rose from 32 per thousand in 2015 to 44 per thousand in 2022, with the age of first use ranging from 12 to 19 years old.

This project also follows on from the legalization of the industrial use of hemp and medical cannabis in the country in 2022, despite the previous government’s initial veto. In addition, current President Rodrigo Chaves expressed support for the legalization of cannabis for recreational use, although this proposal still faces obstacles in the Legislative Assembly.

Mr. Robles’s initiative aims to establish government oversight of personal cultivation. The representative emphasizes that this measure will not only ensure consumer safety but will also help curb illegal sales.

«The reality in Costa Rica today is that cannabis use has increased significantly. This is a reality we cannot ignore. It is happening, and it will continue to happen,» said the congressman from’El Observador.

The Broad Front proposes regulations that would authorize the possession of seeds and grant licenses for the cultivation and use of plants, under the supervision of the National Narcotics Council. This initiative will also focus on individuals who are currently growing plants illegally and who are seeking to regularize their status.
