Andorra Paves the Way for Medical Cannabis Cultivation

The government of’Andorra On September 1, it approved a draft amendment to the Agriculture and Livestock Act. Presented as a modernization of the primary sector, this reform could also be the first step toward the medical cannabis cultivation in the principality.

The text, which does not yet allow businesses or farmers to begin cultivation, but rather establishes a legal framework capable of accommodating new agricultural productions deemed to be in the public interest.

The Minister of the Environment, Agriculture, and Livestock, Guillem Casal, in particular, highlighted the role that the new structures provided for in the reform could play: collective representation bodies and agricultural or livestock groups for joint operations, known as GAREC.

According to the government, these mechanisms are intended to support the modernization and diversification of Andorran agriculture.

A model that is expected to remain highly regulated

The prospect of producing medical cannabis in Andorra does not, at this stage, amount to a general opening of the market. On the contrary, the future framework is expected to be based on a particularly restrictive authorization system.

According to reports about the project by Magazine, the proposed model could, in particular, provide for a single license and a indoor cultivation, subject to strict regulatory requirements. However, these details must still be specified in future specific legislation.

The agricultural reform also provides that certain legally established associations in the primary sector will be eligible for preferential access to certain licenses or permits related to agricultural or livestock activities. The stated goal is to enable professionals in the sector to directly benefit from new opportunities for diversification.

An announcement that patients should take with a grain of salt

For patients, the reform does not yet represent a concrete step forward in terms of access to treatment. Andorra has not announced which products are available, how they will be prescribed, or the terms for reimbursement or distribution.

The immediate challenge is therefore more industrial and regulatory than medical. The country is seeking to create the conditions that will allow new agricultural activities to emerge, among which could be the medical marijuana. This distinction will become important as the project moves forward. In several European markets, the establishment of a production framework did not necessarily result in an immediate improvement in patient access.
