Pennsylvania relies on state-owned stores to sell its cannabis
The Pennsylvania House of Representatives has passed a bill to legalize the sale of cannabis for adult use through state-owned stores, a first in the United States.
Introduced by Democratic representatives Rick Krajewski and Dan Frankel, the law, known as the House Bill 1200, offers a regulated framework in which the Liquor Control Board (LCB) would oversee the retail sale and licensing of cannabis throughout the Commonwealth.
Main provisions of HB 1200
The proposed legislation would allow adults aged 21 and over to purchase cannabis from state-run retail stores, with the LCB also managing the licenses for cultivation, processing and transportation. Private companies would be allowed to operate in these areas under state supervision.
The main measures proposed include
- Legal sales limit: 42.5 grams per adult per day
- THC limits: 25% for flowers; 5 mg per edible portion with 25 mg total in a packet
- Excise tax: 12 %, with proceeds earmarked for criminal record expungement, community reinvestment and addiction treatment programs
- Home growing: Up to two adult and two immature plants with an annual permit of 100 $
- A social and economic equity advisory committee to ensure the inclusion of marginalized groups in the industry.
The bill also introduces the obligation of a social peace agreement, prohibits public consumption and provides for fines for drug possession by minors instead of imprisonment. In particular, local municipalities cannot ban cannabis retail operations, although they can impose a 3 % tax on cannabis lounge-type public consumption spaces.
Political resistance and alternative proposals
The most controversial aspect of HB 1200 is its state store model, which deviates sharply from models seen in other U.S. states. Republican Congresswoman Abby Major, who is preparing a competing bill with Democratic Congresswoman Emily Kinkead, stated bluntly, «There is no vote for a state store model in the Republican caucus.»
The state's Democratic governor, Josh Shapiro, has always included the legalizing the adult use of cannabis in its budget proposals, although he did not explicitly endorse the state-controlled sales framework. While the Democratic Party controls both the Governor's office and the House of Representatives, Republicans retain control of the Senate, setting the stage for complex negotiations.
Senate Majority Leader Joe Pittman recently questioned the bill's immediate prospects, saying there was no clear consensus among legislative leaders and the governor that cannabis should be a priority.
If HB 1200 is passed, Pennsylvania will be the first state-run cannabis retail system, offering a regulatory model unique in the country, and in the image of what's being done in Quebec.
