Polynesia publishes its implementing decrees for the legalization of «cannabis without narcotic properties».»
The regulation of non-narcotic Cannabis is progressing faster in French Polynesia than in mainland France.
The legislative framework, promoted by Moetai Brotherson, aims to provide legal access to non-narcotic hemp products, including varieties and products with less than 0.3% THC at present. Several decrees have been published in the Journal Officiel, paving the way for the controlled cultivation, import and consumption of hemp-derived products.
Main decrees published in the Official Journal
One of the recently published decrees defines the method for quantitative determination of 9-THC and cannabidiol (CBD) in Cannabis sativa flower varieties.
Another decree concerns the safety and visual discretion standards required for the cultivation of Cannabis without narcotic properties. According to the text, these standards aim to «prevent detour, ensure traceability and guarantee the security of production and storage facilities in order to protect vulnerable populations and preserve public safety».
The decree specifies that cultivation sites, as well as drying and storage facilities, must be closed, clearly demarcated and secured to prevent unauthorized access. In addition, cannabis growers, who must have been resident for more than 10 years, must maintain rigorous documentation on the origin and use of seeds to ensure transparency and prevent illegal activities.
A third decree describes authorized cannabis products, specifying which parts of the plant may be used and the obligations imposed on importers. Authorized products include smoking products covered by tobacco legislation, cosmetics, infusions, seed products and dietary supplements.
The bill, initially proposed by the Ministries of Health and Agriculture, establishes a legal basis for the development hemp industry in French Polynesia, while ensuring compliance with French and international regulations.
As far as medical cannabis is concerned, only medical imports will be authorized.
