Gorilla Glue cannabis strains change name
Glue brand Gorilla Glue and cannabis company GG Strains have finally reached an agreement in their lawsuit. Gorilla Glue was suing GG Strains for using and marketing products under similar names, including the famous Gorilla Glue #4.
As of September 19, 2018, the cannabusiness will no longer be able to use the Gorilla Glue name and any image of a gorilla or similar to the glue brand. It will also have to close its site and transfer the domain name to the glue brand before January 1, 2020, which will not use it.
Other terms of the agreement include the following:
- the two parties cannot denigrate each other
- GG Strains has 12 months to stop using the word «Gorilla», an image of a gorilla or the «Gorilla» trademark, but will be able to use these elements preceded by «previously known as» until September 19, 2018.»
- affiliates, dispensaries, growers and other partners must also stop using the word «Gorilla» and any Gorilla Glue brand elements.
The initial complaint had been filed in March, for trademark infringement, dilution, unfair competition and cybersquatting. By marketing and selling its products under the «confusingly similar names» of Gorilla Glue #4, Gorilla Glue #5 and Gorilla Glue #1, GG Strains would be taking advantage of the positive reputation of Gorilla Glue Co. that it had built up over its 23 years in business.
Representatives of GG Strains had denied the accusations, explaining that brands with similar names could coexist: Delta (an airline and a brand of faucets) or Dove (soap and chocolate). They also noted their intention to migrate their Gorilla Glue varieties to GG4, GG5 and GG1.
Their rebranding efforts will therefore have to go further, and the new variety names will therefore be: Original Glue for GG4, New Glue for GG5 and Sister Glue for GG1.
No financial agreement has been reached, but GG Strains estimates the cost of rebranding at 250,000$.
