Frenchman Tom Félix faces death penalty for cannabis in Malaysia
Tom Félix, a 32-year-old Frenchman living in Malaysia, is currently embroiled in a grueling legal battle. He was arrested on August 9, 2023, in Langkawi, Malaysia, after police found a few grams of cannabis in the apartment he shared with roommates. That was the beginning of the nightmare.
He has been on trial since Monday in Malaysia, where he faces the death penalty.
Arrest and Allegations
Tom Félix was arrested by Malaysian authorities after cannabis was found in the common areas of the apartment he shared with others. The Malaysia's very strict anti-drug laws are well-known and provide for severe penalties, including the death penalty but no longer on a systematic basis, for drug trafficking. Tom's family is convinced that he is innocent and that he was simply in the wrong place at the wrong time.
Tom’s parents, Sylvie and Jean-Luc Félix, expatriate teachers in Singapore, received a distressing call from their son shortly after his arrest. Tom, in a panic, urged them to contact the French Embassy and to hire a lawyer to represent him. Although he maintains his innocence, Tom faces a grueling wait until his trial, which is scheduled for June 2025.
The Family's Plea and Diplomatic Involvement
The Félix family has expressed concerns, particularly regarding Tom’s inadequate legal representation and his conditions of detention. Sylvie and Jean-Luc Félix describe the legal proceedings as opaque, with what they call «sham hearings» that lead to no progress.
Their attempts to secure the support of the French authorities met with limited commitment. French diplomats were reluctant to intervene too aggressively, citing potential accusations of interference in Malaysia’s judicial process.
Tom Félix’s situation in prison, however, is alarming. Reports indicate that he is being held in overcrowded conditions, sharing a cell with 20 to 40 other inmates. His health has deteriorated significantly; he has lost weight, is suffering from scabies and infected wounds, and is reportedly in the midst of a tuberculosis outbreak.
Sylvie Félix expressed her deep concern about the inhumane conditions, including poor hygiene and frequent physical abuse by prison guards. Despite sending money to help Tom get the medicine and food he needs, the family’s efforts to alleviate his suffering are limited by the dire circumstances.
Legal Disagreements and Public Defense
The inconsistencies in the legal proceedings have compounded the distress of Tom’s family. Initial reports indicated a small amount of cannabis, but the figures have since risen dramatically to 1.8 kilograms. This discrepancy, along with the admission by one of Tom’s roommates that the drugs belonged to him, raises questions about the fairness of Tom’s treatment.
In response to this situation, Tom’s friends founded the «Free Tom» organization to raise public awareness and collect funds for his legal defense and related costs.
While Tom awaits his trial, his family continues its fight for justice. They are determined to ensure that his case receives the attention it deserves and that his rights are respected throughout the legal proceedings. The international community, particularly those involved in human rights advocacy, is closely following developments in this complex and troubling case.
The young man's parents met with Emmanuel Macron on May 30, while he was on an official visit to Singapore.
«He listened to us and said that this situation is indeed unacceptable and that he would do everything in his power to ensure that Tom is released,» Ms. Félix said after the meeting with the French president.
